Privacy Policy

EDGE Business District Association (“we,” “us,” or “our”) operates the text-message voting program for the Booker Creek Arts Festival in St. Petersburg, Florida. This Privacy Policy explains what information we collect when you register and vote by text message, how we use it, and the choices you have. By participating in the voting program, you agree to the practices described below.

Information We Collect

When you register to vote through our registration form and cast votes by text message, we collect:

  • Your first and last name, provided on the registration form
  • Your mobile phone number
  • The artist voting code or option you submit
  • The date and time your message is received
  • Any keyword or message content you send to the voting number, such as STOP or HELP

We do not ask for your email address or any other personal information in order to vote. We do not collect location data, contacts, or any information from your device beyond the information you provide on the registration form and the messages you send.

How SMS Voting Works

Visitors first register to vote by completing a registration form, reached by scanning a QR code on official signage at the festival entrance. The form collects your first name, last name, and mobile phone number, and includes a consent disclosure describing the text messages you will receive. After registering, visitors voluntarily initiate all voting SMS messages by texting an artist’s unique voting code to the official Booker Creek Arts Festival voting phone number. Each submission generates a single transactional response confirming the submitted vote or explaining why the vote could not be processed, such as an invalid code, duplicate vote, unregistered number, closed voting period, or processing error.

Users are not enrolled in recurring messaging. No promotional or marketing messages are sent through this voting program.

How We Use Your Information

We use the information we collect only to:

  • Register you as a People’s Choice Award voter and record and tally votes for the Booker Creek Arts Festival.
  • Detect and prevent duplicate or fraudulent voting.
  • Send you a confirmation that your vote was received or explain why it could not be processed.
  • Respond to HELP requests and process opt-out requests.
  • Maintain the integrity and administration of the event.

Text Messaging Consent

By submitting the voting registration form with your mobile phone number, you expressly consent to receive text messages related to People’s Choice Award voting, including a one-time registration confirmation and one SMS response for each vote you submit. Responses may include a vote confirmation, an invalid-code message, a duplicate-vote message, a voting-closed message, or another transactional response related to your submitted vote.

Message frequency is limited to voting-related responses and may vary based on the number of vote submissions you send. Message and data rates may apply. You can opt out at any time by replying STOP. Reply HELP for assistance. For details, please see our SMS Terms of Service.

How We Share Your Information

We do not sell, rent, or trade your information to anyone.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may share information only in these limited situations:

  • With service providers, such as our messaging platform Twilio, strictly to operate the voting program on our behalf.
  • When required by law, subpoena, or other legal process.
  • To protect the rights, safety, or property of EDGE Business District Association, event participants, or the public.

These service providers are bound to use your information only to provide services to us and may not use it for their own purposes.

Data Retention

We retain voting records only as long as needed to administer and verify the results of the Booker Creek Arts Festival. We delete or anonymize collected names and phone numbers within 30 days after the event concludes, except where we are required to retain information by law.

Data Security

We use reasonable administrative, technical, and physical safeguards to protect the information we collect. No method of transmission or storage is completely secure, but we work to protect your information against unauthorized access, use, or disclosure.

Your Choices

You can stop receiving messages from the voting program at any time by replying:

  • STOP
  • STOPALL
  • UNSUBSCRIBE
  • CANCEL
  • END
  • QUIT

After you opt out, we will not send you further messages unless you re-initiate contact by texting the voting number again.

Children’s Privacy

The voting program is intended for a general audience and is not directed to children under 13. We do not knowingly collect information from children under 13. If you believe a child has provided us with information, please contact us so we can remove it.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date above. Continued participation in the voting program after changes take effect means you accept the updated policy.
